Silent North Interactive · Terms for the driver companion app

TruckDuty Terms of Service

Effective date: November 5, 2026
Version: 1.0

1. Provider and contact

  1. The TruckDuty mobile application (the “App”) is provided by Mateusz Kubik, operating under the developer name Silent North Interactive (the “Provider”).
  2. Provider address: Janki Bryła 21/1, 81-577 Gdynia, Poland.
  3. Contact for support, complaints, and user rights: [email protected].
  4. These Terms describe the conditions for using the App and its related services. They are made available free of charge and can be saved or printed.

2. Purpose and functionality

  1. TruckDuty helps drivers maintain their own records relating to work and vehicles.
  2. Depending on the App version and permissions, features may include work calendars; start/end times; mileage; start and end countries; loading and unloading entries; notes; fuel and consumption records; GPS route history, stops and saved places; PDF and CSV reports; vehicle profiles; driver information guides; optional Google sign-in; and optional cloud synchronization.
  3. Availability may depend on the device, operating system, permissions, connectivity, and a selected subscription plan if paid access is offered.
  4. TruckDuty is not a tachograph, an official working-time record, a navigation device, or a certified transport-compliance system. Users must check their records and comply with applicable laws independently.

3. Technical requirements and responsible use

  1. The App requires a compatible Android device and sufficient storage. Current system requirements appear in the Google Play listing.
  2. Internet access may be needed for updates, Google sign-in, cloud synchronization, and third-party services. Core local records may be available offline.
  3. GPS features require location permissions. Background tracking may require additional permissions and may be affected by device power-management settings.
  4. Users must use the App lawfully, must not attempt unauthorized access, and must not submit unlawful material.
  5. Do not operate the App while driving if doing so could distract you or violate traffic-safety laws.

4. Starting and ending use; accounts

  1. Use of available free features begins when a user starts using the App. Purchases of paid access are completed through the checkout process described in section 7.
  2. A Google account is optional for local use. Google sign-in may be required for cloud synchronization.
  3. Users are responsible for protecting their devices and Google accounts and for the accuracy of the information they enter.
  4. Users may stop using the App and uninstall it. Uninstalling does not automatically delete cloud data or cancel an active subscription.
  5. Information on requesting account and cloud-data deletion is available at https://truckduty-5e8cb.web.app/.

5. User records, synchronization, and export

  1. User records may be stored locally and, when enabled, synchronized using Google Firebase services.
  2. Users retain rights to the records they create. They authorize the Provider to process, store, and synchronize those records only as necessary to provide the service.
  3. Users should regularly review their records and use available export or backup options. Device failures, account-access loss, and interrupted synchronization may affect data availability.
  4. Personal data handling is explained in the Privacy Policy: https://truckduty-5e8cb.web.app/privacy.html.

6. GPS and transport guidance

  1. Location tracking is optional and starts at the user's request or through automation previously enabled by the user. Tracking may continue in the background when enabled.
  2. Route, stop, position, and timing accuracy depends on satellite reception, the phone, environmental conditions, and Android restrictions.
  3. Driver information, including ADR and driving/rest-time guidance, is provided for reference only. It does not replace current legislation, transport documents, manufacturer instructions, or professional judgment.
  4. Users remain responsible for work and driving decisions. This does not limit mandatory consumer protections.

7. Subscriptions, pricing, and trials

  1. Some App features may be offered through paid Google Play subscriptions. If subscriptions have not yet launched, these provisions apply once they become available.
  2. Price, currency, billing frequency, paid features, trial conditions, and the first charge date are displayed in the Google Play purchase offer and confirmation. The terms clearly presented before an individual purchase govern that purchase, subject to applicable law.
  3. Subscriptions renew automatically according to the checkout terms unless canceled before renewal. Payments and billing are processed through Google Play.
  4. If a free trial is offered, its duration and the conditions for converting to paid access will be displayed before acceptance. To avoid a renewal charge, cancel before the applicable billing date shown in Google Play.
  5. The Provider does not unilaterally change the price for a billing period already paid for. Changes to renewal pricing are subject to Google Play rules and applicable law.

8. Cancellation, withdrawal rights, and refunds

  1. Subscriptions can be managed through Google Play → Payments & subscriptions → Subscriptions (labels may vary). Cancellation stops future renewals; paid access generally remains until the end of the paid period unless the purchase terms or law provide otherwise.
  2. Uninstalling the App does not cancel a subscription.
  3. Refund requests can be submitted through Google Play procedures or sent to the Provider's contact email in section 1.
  4. Consumers retain any mandatory statutory withdrawal, digital-content, digital-service conformity, and remedy rights. Exceptions to withdrawal rights apply only where all relevant legal requirements, including information and consent requirements, are met. These Terms do not waive those rights.

9. Support and complaints

  1. Technical issues, questions, and complaints can be sent to [email protected].
  2. Helpful information includes the issue description, App and operating-system versions, approximate time of the problem, and — if relevant — the Google Play order reference. Do not send passwords, verification codes, or unnecessary sensitive information.
  3. The Provider will acknowledge and respond to complaints within the period required by applicable law; for Polish consumer complaints, generally no later than 14 days after receipt unless a different legally applicable period applies.
  4. Consumers may use statutory remedies and available alternative dispute-resolution mechanisms.

10. Availability, updates, and liability

  1. The Provider may release security, compatibility, and functionality updates and provide updates required to keep a digital service in conformity with the contract where required by law.
  2. Temporary interruptions may occur due to maintenance, connectivity problems, service-provider outages, or technical issues.
  3. GPS records, fuel calculations, and reports may contain inaccuracies caused by incorrect user inputs or technical limitations.
  4. Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

11. Intellectual property

  1. The TruckDuty name, original interface, software, and Provider-authored materials are protected under applicable law, subject to licenses of third-party components.
  2. Users receive a non-exclusive right to use the App on their devices for its intended purpose and under applicable licensing terms. No ownership of source code or App branding is transferred.
  3. Users retain rights to their own records and notes.

12. Changes and final provisions

  1. These Terms may be updated for legitimate reasons, including changes in law, functionality, service operation, or contact details. The current version and date will be displayed on this page.
  2. Users will be informed about material changes affecting ongoing paid services as required by applicable law; changes do not override accrued rights or statutory termination rights.
  3. Applicable law, including mandatory consumer-protection rules, governs matters not expressly addressed here. The choice of Polish law does not deprive consumers of mandatory protection available under the law of their habitual residence where applicable.
  4. Court jurisdiction is determined by applicable law. These Terms do not impose exclusive jurisdiction at the Provider's place of residence on consumers.
  5. The Polish text is the primary version; the English translation is provided for convenience. This does not limit users' mandatory legal rights.
